The Landscape of GRAS: From Here to the Horizon
The principle of generally recognized as safe (GRAS) ingredients in food and the mechanism of GRAS determinations by scientific procedures for new food ingredients and for new uses of food ingredients are key instruments in the advancement of food technology and food safety. As the food and dietary supplement industries recollect and celebrate 50 years of GRAS under the Food, Drug and Cosmetic Act (FDCA) Amendments of 1958, there is widespread recognition that scientific, social, political and market forces are increasingly influencing the GRAS determination process and the GRAS status of food ingredients in new ways. Several of these forces and their potential impact on the status of GRAS ingredients and the GRAS determination process will be evaluated by means of case studies. Attend this session to hear discussion of the following: the requirement of more complete intake data for current best practices in safety assessment; the imminent implementation of section 912 of the FDA Amendments Act of 2007 that creates section 301(II) of the Food, Drug and Cosmetic Act (FDCA); and the influence of regulatory schemes and safety authorities outside the U.S.

This presentation will provide understanding into the new horizon for private label as well as offer ways name brands can effectively compete with private label going forward. The overarching goal is to provide an accurate portrayal of the changing landscape of the private label market and the associated strategic business implications for retailers and manufacturers of name brands and private label branded products. The presentation will focus on foods and beverages, and will include information on what a brand is, perceptions and purchase behavior, quality distinctions, value, packaging and labeling, and marketing and messaging.

Total Recall: The ABCs of Voluntary Recalls in the Food and Beverage, Dietary Supplement and Cosmetic Industries
Hear industry attorneys address some of the most recent issues that have warranted recalls by companies in the food and beverage, dietary supplement and cosmetic industries, including labeling, ingredient and contamination issues. A discussion of the applicable statutes and regulations implicated with those issues will be discussed, along with the considerations in determining whether a recall is necessary. Common fallacies about recalls will be clarified, such as the misconception that FDA mandates recalls instead of the reality that companies initiate voluntary recalls in most cases. Hear about the steps that should be taken to initiate a voluntary recall, including communications with and submissions to FDA and communications with manufacturers, suppliers, distributors and insurance carriers. The session will conclude with a discussion about precautionary steps that a company can employ to lessen the impact of a future recall, such as drafting manufacturing and supply agreements to include indemnification clauses for damages suffered from recalls and maintaining proper insurance to cover costs associated with a recall.
