Going Green and Telling the Consumer: The Use of Environmental Claims in Advertising, Marketing and Labeling of Food and Beverage, Supplement and Cosmetic Products

With increased frequency, many consumers are making purchase decisions based on which companies and products are the most “eco-friendly.” As the demand for “environmentally-conscious” products increases, claims touting the positive environmental impact of products, also known as “green” claims, have continued to rise as well. In this session, Justin Prochnow will discuss the general concepts of "green advertising" and the movement by companies to move toward more "environmentally-conscious" products and "green" claims. The law regarding the advertising, labeling and marketing of products using "green claims" will be reviewed, with a focus on the "Green Guides" issued by the FTC. Prochnow will walk-through the Green Guides and the related guidances issued by FTC that interpret and clarify the Green Guides, as well as the current process of revising the "Green Guides" undertaken by the FTC. Additionally, he will cover some of the recent enforcement actions by the FTC, as well as disputes governed by the NAD, in the area of "environmental claims". This presentation will conclude with a discussion about "green washing" and the negative impact companies accused of "green washing" by environmental watchdog groups can suffer for making unsupported or false "green" claims.

The ODS Strategic Plan: 2010-2014

The Office of Dietary Supplements (ODS) was created by DSHEA in 1994 and began work at the National Institutes of Health (NIH) in 1995. Since that time, its efforts have been guided by a succession of strategic plans. The most recent one, covering 2010-2014 and entitled Strengthening Knowledge and Understanding of Dietary Supplements, was released in January 2010, after a year-long assessment of our progress and plans and with input from many stakeholders. Like its predecessors, the Plan emphasizes the role of ODS in research and education in the field of dietary supplements. During the 15 years ODS has existed, research has expanded in many ways, and ODS is pleased to be a major participant in that expansion. In addition to funding research grants with other institutes and centers at NIH, ODS has also initiated the development of several programs intended to build capacity for research in the area: analytical methods and reference materials for compounds and extracts, as well as for biomarkers of nutritional status; evidence-based reviews of dietary supplement efficacy and safety; a database of dietary supplement ingredients; and most recently, creation of a population studies program in ODS to expand capability in examining the use of dietary supplements by the public and its relationship to health outcomes. We have also led government efforts to enhance research and inform public policy about the health effects of nutrients such as vitamin D. These research-oriented activities will continue to grow to meet public health needs. All of these activities are built on collaborations with other government agencies, with the private sector, and with academia. On the education side, ODS has emphasized its role in providing reliable information about issues in dietary supplements to practitioners and the public through its expanded series of fact sheets and other media, through lectures and presentations at scientific and industry-oriented meetings, and through publications aimed at our stakeholders.
